"Media
freedom guaranteed in constitutional drafts" (Andrew
Kipkemboi)
The
freedom and independence of the media is guaranteed in the proposals
of the draft constitution. State shall not exercise control over
or interfere with any person or person or institution. It shall
not harass or penalize them for any opinion or view or the content
of any such broadcast, publication or dissemination.
The document also states that all state-owned media shall be independent
and impartial and shall accord fair opportunities and facilities
for the presentation of divergent views and dissenting opinions.
And that Parliament shall enact a law that makes all State-owned
media and "other specified category" to allocate equitable
airtime to all political parties.
- Every citizen has the right of access to information held by
the State and that the Government has the obligation to publish
and publicize any important information affecting the life of
the nation.
- Every person has the right to freedom of association, this right;
it says, includes the right to formation, operation and continued
existence of the organizations.
- Every person has the right, peaceably and without the requirement
of prior permission to assemble, to demonstrate, to picket or
to present petitions to public authorities.
-Every citizen is free to make political choices, which include
the right to form, or participate in forming a political party
or participate in forming a political party. He/she is free to
participate in the activities of the said party, by recruiting
other members or campaigning for it.
- Every citizen has the right to enter into, remain in and reside
anywhere in the republic.
- Every person has the right to social security. It proposes that
the State shall provide social security to persons who are unable
to support themselves or their dependants. Parliament will within
three years of the coming into force of the Constitution enact
legislation to give effect to this article.
- Every person has the right to education and that the Government
shall institute a programme to implement the right of every child
to free and compulsory pre-primary and primary education. And
that the State shall make available and accessible secondary and
post-secondary education.
